If you own or manage commercial property in the Southeast — a retail center, an office park, a multifamily community — sooner or later a site plan lands on your desk with a pond drawn into a corner of the lot. The engineer calls it detention or retention, and the two words often get used as if they mean the same thing. They do not. The difference determines how much land you give up, what you are liable for, and what you will pay to maintain the site for the next several decades.
The Real Difference
A detention pond holds stormwater temporarily. During a storm it fills, and afterward it releases that water slowly through an outlet structure — a weir, an orifice, a riser pipe — back into the municipal system or a natural channel. Between storms it sits empty, or nearly so. Its job is timing: it flattens the peak flow so the downstream system is not overwhelmed all at once.
A retention pond holds water permanently. It is designed with a standing pool — the wet pond you see behind so many Southeast subdivisions and shopping centers. New runoff pushes older water out slowly, and the permanent pool provides water-quality treatment as sediment and nutrients settle out before discharge. Its job is both volume and quality.
Put simply: detention controls the rate at which water leaves; retention also controls what leaves, and keeps a permanent pool while it does.
When Each Is Required
You rarely get to choose freely. The choice is driven by stormwater regulation. Most Southeast development falls under an MS4 (Municipal Separate Storm Sewer System) permit program and the federal NPDES framework, which set both peak-flow limits and water-quality standards for what you discharge.
- If your local standard is strictly about peak flow — do not send water downstream faster than the pre-development site did — a detention basin often satisfies it.
- If the standard also requires treatment of the first flush and nutrient removal, which most MS4 jurisdictions in Georgia, Florida, and the Carolinas now do, a retention pond or an equivalent treatment practice is usually mandated.
Florida in particular treats stormwater as a water-quality issue first, and many counties there effectively require a permanent treatment volume. Requirements vary parcel to parcel, so the specific permit conditions for your site govern the decision — not a rule of thumb, and not what worked on the last project.
The Maintenance and Liability Burden
Both pond types are open surface water, and that is where the ongoing cost lives. Owners consistently underestimate it.
Maintenance
- Sediment accumulates and must be dredged out periodically, often on a 10-to-15-year cycle, to preserve capacity.
- Outlet structures clog with debris and have to be inspected and cleared, typically after every major storm.
- Embankments and side slopes need mowing, erosion repair, and control of invasive vegetation.
- Wet ponds add algae, mosquito, and odor management to the list.
Liability
A permanent pool of open water on a property with residents, customers, or the public is a standing safety exposure — drowning risk, fencing and signage obligations, and the insurance premiums that follow. It also consumes land. A pond and its required buffer can take a meaningful fraction of a lot that could otherwise be leasable, parkable, or buildable. On a tight commercial parcel, that lost acreage is often the most expensive part of the whole system.
A surface pond is not a one-time construction cost. It is a permanent line item on your maintenance budget and a permanent entry on your risk register.
Reducing Your Reliance on Surface Ponds
Here is where the engineering question opens up. The reason so many Southeast sites default to surface ponds is that traditional drainage is gravity-fed — French drains, gravel trenches, perforated pipe — and gravity needs slope to move water. On the flat, clay-heavy lots common across the region, there is nowhere for gravity water to go, so it gets collected in a pond and released slowly. The pond exists because the drainage cannot do the work.
