The most expensive response to a neighbor's runoff is a berm. Push a mound of soil along the property line and one of two things happens. The water finds the low end and comes through anyway, or it backs up on their side and you get a certified letter. Either way you have spent money and damaged the relationship without moving a gallon off your lot.
Water crossing a property line is a physical problem with a physical fix. It is worth understanding the physics before anyone talks about the law.
Where the Water Is Actually Coming From
"Uphill neighbor" is a description, not a diagnosis. Four situations produce cross-boundary flooding, and they call for different fixes.
1. Grading That Changed Uphill
New construction, a pool installation, a regraded back yard, a removed tree and its root plate — any of these change where surface water goes. A lot that shed water evenly for twenty years can start funneling it into one corner after a single weekend of landscape work. This is the most common cause, and the flow path is usually visible in the turf as a darker, flattened stripe.
2. Concentrated Discharge
A roof is an impervious surface. A 2,400-square-foot roof sheds roughly 1,500 gallons in a one-inch rain, and downspouts deliver that volume to four or five points instead of spreading it across the lot. Add a sump pump cycling every fifteen minutes, a driveway pitched toward the side yard, and HVAC condensate, and an uphill property can send more concentrated water at your lot than the rain falling on your lot does. Georgia's 50-plus inches of annual rainfall arrives in short, intense summer storms, which makes the peaks worse than the totals suggest.
3. A Failed Drain on Their Side
If the neighbor installed a French drain that has since silted in, the flooding you are seeing may be recent and unintentional. Gravel trenches in red clay clog from the outside in: fines migrate into the void space between stones, the trench stops accepting water, and everything it used to carry now runs on the surface — often along the same alignment, straight at your fence line.
4. You Are the Natural Low Point
Sometimes nothing changed. Your lot is simply where water in that drainage area has always collected, and you noticed it when you finished the basement or laid sod. This one matters, because it changes both the fix and the conversation.
The Legal Part, Briefly
Most Southeast states apply some version of a reasonable-use rule: an owner may make ordinary improvements even when they alter runoff, but may not concentrate or divert water onto a neighbor in a way that causes unreasonable harm. Piping a sump discharge to the property line is a different act from grading a lawn. Local ordinances and HOA covenants often add requirements on top of that.
That is a general description and not legal advice — outcomes turn on specific facts. The practical point is that documentation carries more weight than argument. Dated photos taken during a storm, a record of what changed uphill and when, and a written note of what you asked for are worth having. A berm built out of frustration is not.
Most neighbor runoff disputes get settled by a drainage plan, not a lawyer. The water has to go somewhere either way. The only question is whether it goes there on purpose.
How to Diagnose It Before You Spend Anything
- Walk the property line during a rain event, not after — note where water crosses, how wide the flow is, and whether it is sheet flow or a defined channel
- Photograph it with a timestamp, then again 24 hours later to show how long it stands
- Trace every downspout, sump discharge, and driveway edge uphill of you, and note which ones point your way
- Check whether flooding tracks with storm intensity or with total rainfall — bursts point to concentrated discharge, long saturation points to percolation
- Run a percolation test in the wet area; if your clay takes less than a quarter inch an hour, upstream changes alone will not drain your yard
- Find your actual outfall, the lowest point where water can leave your lot — if there isn't one, that constraint shapes every solution
Matching the Fix to the Cause
- Concentrated discharge with an outfall available → ask for downspouts and sump lines to be extended to a dispersal point, then intercept what remains at your line
- Sheet flow across a wide front → an interception system along the upgradient edge, sized for the contributing drainage area rather than the width of the wet spot
- Flat lot with no outfall → pressure-fed drainage with retention, because nothing that depends on slope will work
- Failed French drain uphill → a real repair on their side, since anything you build downhill is a bandage on their failure
Why Interception Trenches Usually Fail
The standard answer to boundary runoff is a French drain along the property line. It fails in Southeast clay for the same reason it failed uphill. It needs fall to move water, and it depends on the void space between stones staying open. Clay fines fill that space. Within three to seven years the trench is a buried line of dirty gravel, and the homeowner concludes that drainage does not work here.
